1. Introduction & Acceptance

Welcome to GVD Soni's Cafe! These Terms & Conditions ("Terms") govern your access to and use of our website, mobile applications, APIs, and associated services (collectively, the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use our services.

2. Account Registration & Security

To access certain features, such as the GVD Black rewards program, you must register for an account.

• You must provide accurate, current, and complete information during registration.
• You are responsible for safeguarding your login credentials (including OTPs) and are fully responsible for all activities that occur under your account.
• You must notify us immediately of any unauthorized use or security breach of your account.

3. Orders, Pricing & Payments

All orders placed through the Platform are subject to acceptance and availability.

• Pricing: Prices shown on the menu are inclusive of applicable taxes unless stated otherwise. Prices are subject to change without notice.
• Payments: We accept various payment methods through secure payment gateways. You agree to pay all charges incurred in connection with your order, including applicable delivery fees and taxes.
• Cancellations & Refunds: Orders cannot be cancelled once the preparation process has begun. Refunds for failed deliveries due to our fault will be processed in accordance with our refund policy.

4. Delivery & Fulfillment

We aim to deliver your food hot and fresh within the estimated delivery time. However, delivery times are estimates and may vary due to weather, traffic, or order volume. GVD Soni's Cafe is not liable for delays caused by circumstances beyond our reasonable control. You must ensure you are available to receive the order at the specified address.

5. Franchise Terms

Inquiries and applications for GVD Soni's Cafe franchises submitted through the Platform are subject to separate, formal agreements. Information provided on the Platform regarding franchise opportunities does not constitute a binding offer or guarantee of approval.

6. Intellectual Property

All content on the Platform, including but not limited to logos, branding, menu descriptions, text, graphics, and software, is the property of GVD Soni's Cafe or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or modify our content without explicit permission.

7. User Conduct & Prohibited Activities

While using the Platform, you agree not to:

• Use the Platform for any illegal, fraudulent, or unauthorized purpose.
• Attempt to hack, destabilize, or exploit the Platform's infrastructure.
• Abuse the refer & earn system, GVD Black rewards, or any promotional offers through fake accounts or manipulation.
• Harass, abuse, or mistreat our delivery partners or cafe staff.

8. Limitation of Liability

To the maximum extent permitted by law, GVD Soni's Cafe shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform or the food products ordered. Our total liability for any claim arising out of these Terms shall not exceed the amount you paid for the specific order in question.

9. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Platform and updating the "Last updated" date. Your continued use of the Platform after such changes constitutes your acceptance of the new Terms.

10. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms, the Platform, or your orders shall be subject to the exclusive jurisdiction of the courts located in Jaipur, Rajasthan.
